CONTEST OVERVIEW: The “Kiss Me I’m Fabulous” Contest (the “Contest”) is sponsored by Fabunation LLC, 414 Hobsons Choice, Webster, New York 14580 (“Sponsor”). The Contest is governed by these official rules. Through their participation in the Contest, each participant agrees to abide by and be subject to these Official Rules and understands that the Sponsor-determined results of the Contest will be final in all respects.

ELIGIBILITY: The Contest is open to natural persons that are legal residents of the 50 United States of America and the District of Columbia having Internet access, are 13 years of age or older, and have a valid e-mail account. Residents of any state or locality where a promotion such as the Contest is prohibited or restricted by federal, state or local laws or regulations because of an age restriction or otherwise, are prohibited from participating in the Contest. Directors, officers, employees and representatives (and their immediate family members (defined as parents, spouses, children, siblings and grandparents) and individuals residing in the same household of such family member) of (i) Sponsor, (ii) any advertising or promotional agency of Sponsor, or (iii) any parent, subsidiary or affiliate of any entity listed in clauses (i) and (ii), are ineligible to participate in or win the Contest. Sponsor reserves the right to verify the eligibility of each entrant of the Contest.

HOW TO ENTER THE CONTEST: Beginning at 10:00am (E.S.T.) on February 1, 2009 through 12:00am (E.S.T.) on June 1, 2009 (the “Contest Period”), log on to the “Kiss Me I’m Fabulous” website at http://www.kissmeif.com (the “Contest Website”). Click on the “Contest” link and follow the on-screen registration instructions and submit all of the required information to become an eligible participant in the Contest (the “Participant”). To enter the Contest, the Participant must log in to the Contest Website any time during the Contest Period and perform one of the following actions according to the on-screen instructions: (i) utilize the “Liptastic” feature; (ii) execute the “Blow a Kiss” feature; (iii) respond to the “Daily Survey” feature; or (iv) benefit from the “Beauty Expert” feature (collectively, the “Website Features”). Each time the Participant performs an action with one of the Website Features, the Participant will automatically receive an entry into the Contest (each, an “Entry” and together, “Entries”). The Participant may receive an unlimited number of Entries while logged in to the Contest Website during the Contest Period. Each Entry for the Contest must be received by Sponsor during the Contest Period. Sponsor reserves the right to determine what amounts to a “received” Entry.

CONTEST: The Contest will be conducted by Sponsor during the Contest Period. Each day during the Contest Period, Sponsor will randomly select up to five winners (each, a “Winner”) of a prize (“Prize”) from all valid and eligible Entries received by Sponsor through the Contest Website up until that point in time from the Participants. The Contest will have multiple Winners. The Participant may be eligible to win more than one Prize. Each Winner will be notified via the contact information provided in the Participant’s registration information within seven days of being selected. In the event Sponsor can not reach a Winner within seven days, the Prize will be forfeited and Sponsor will select a new winner from the remaining Entries received. If any Winner is not eligible to receive a Prize or declines to accept a Prize, Sponsor will select a new winner.

CONTEST PRIZES: Sponsor reserves the right to determine and select what each Prize a Winner will receive. Prizes consist of either lipstick or lip gloss. The value of any single Prize will not exceed $10.00. In the aggregate, the Contest will award Prizes that have a total value not to exceed $1,500.00. Odds of winning depend on the number of Entries received and the number of Prizes awarded. For purposes of these Contest Rules, Sponsor estimates that 20,000 individual Participants may visit the Contest Website during the Contest Period.

PRIZE RESTRICTIONS: No Prize will be redeemable for cash value. Prizes will be selected and awarded at Sponsor’s sole discretion. All Prizes will be awarded upon receipt from Winner of a shipping address. Prizes will be awarded subject to Sponsor’s verification of Winner’s eligibility under these Contest Rules. Prizes are non-transferable; no substitutions will be allowed except by Sponsor due to unavailability, in which case substitution will be of equal or greater value as selected at Sponsor’s sole discretion. All applicable taxes and any other costs not specifically stated herein are the responsibility of Winner. Any and all guarantees and warranties of the merchandise awarded as a Prize are subject to the merchandise manufacturer’s terms and conditions, and Winners agree to look solely to such merchandise manufacturers for any such warranty or guarantee claim. Sponsor provides no warranty, implied or otherwise, as to the workmanship and materials used in relation to any Prize.

GENERAL: All federal, state and local laws apply. Void where prohibited by law or regulation. By participating in the Contest, any Participant: releases Sponsor, and its respective officers, employees, agents, parents, subsidiaries, affiliates, advertising and promotion agencies (collectively, the “Sponsor Affiliates”) from any and all liability, including without limitation, property damage, personal injury and/or death, resulting from such entrant’s participation in the Contest or acceptance, use or misuse of any Prize. Any entrant further agrees that the Sponsor Affiliates are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the Contest and the awarding of the Prizes. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, each entrant agrees that, by entering the Contest (i) any and all disputes, claims, and causes of action arising out of or in connection with the Contest, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney’s fees or court costs; and, (iii) under no circumstances will any entrant be permitted to obtain any award for, and by entering participating in the Contest, each entrant irrevocably waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased, other than damages for actual out-of-pocket expenses. Failure to comply with these Contest Rules will result in disqualification from the Contest. Sponsor is not responsible for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to obtain entry form and information on account of technical problems or traffic congestion on the Contest Website or at any other web site or any combination thereof or any injury or damage to Participant’s or any other person’s computer related to or resulting from participating in the Contest. In the event the integrity of the Contest becomes compromised, in any manner, as determined in Sponsor’s sole discretion, Sponsor reserves the right to cancel or modify the Contest and to select a Winner from those eligible Entries received up to the date of cancellation/modification of the Contest. Sponsor may engage certain third parties to perform services in connection with the administration of this Contest and information provided by entrants may be collected and used by those third parties for purposes of administration of the Contest and the fulfillment and verification of Prizes.

LEGAL WARNING: ANY ATTEMPT BY AN INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY INTERFERE WITH THE OPERATION OF THE CONTEST, IS A VIOLATION OF CRIMINAL & CIVIL LAWS AND SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
